Judicial review is the power of the courts to declare laws from any government invalid if they contradict the United States constitution There is a lot of argument about this concept Is it fair Is it constitutional Is it even a valid idea These questions all stem from the single fact that Judicial Review is not mentioned in the constitution at all Despite this the process of judicial review is one that is well known and it was used by most of the state governments before the establishment of the state court This process was not even formally recognized until the outcome of Marbury vs Madison was established In this case Mr Marbury was appointed by congress at the end of John Adams presidency Many others were also appointed along with him Adams had ordered for the commissions to be delivered to the newly elected justices However before they could all be delivered after being sworn in as the new president Thomas Jefferson stopped the delivery of those commissions The people whom had not received their commissions became disgruntled and sued for their positions in congress The outcome of the court case was based on 2 quotes from the constitution The fundamental and paramount law of the nation and an act of the legislature repugnant to the constitution is voidBasically these quotes mean that when the constitution conflicts with an act of legislature the act becomes invalid From this case the process of judicial review was formed Now referring back to the questions as stated before there are several advantages of this system we use in our country but there are also several disadvantages One very important advantage of this process is that it allows the judicial branch to check the power of another branch This is important because it allows all 3 of the branches to keep balance between them and not allow one to get more powerful than the others On the flip
