Joseph Elgabalawi English 12-1pm Kay First Amendment Rights The First Amendment to the United States Constitution provides that Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof or abridging the freedom of speech or of the press or the right of the people peaceably to assemble and to petition the government for a redress of grievances Granted the acts of such orders as the Ku Klux Klan Black Panthers and the Skinheads surpass the protection of the First Amendment However the mere beliefs of each of these organizations can not be diminished from society Under the Constitution of the United States the American people are free to have faith and believe in anything they choose too To prevent any of these groups from their beliefs is equally as unjust as preventing the late Mother Teresa from her beliefs Such beliefs are well protected under the First Amendment however expressing these beliefs with the intent of instigating animosity or conflict is not prote cted by the First Amendment The fighting words law then comes in to affect Thus creating a gap between what is protected by the Constitution and what is not When racist speech takes the form of face-to-face insults catcalls or other assaultive speech aimed at an individual or small group of persons then it falls within the fighting words exception to first amendment protectionCooper and Macdonald Schools through out the United States have gone through endless debates over the limits of speech or if they should even exist Many schools have adapted rules and laws of limiting speech Like Charles L Lawrence III I believe that limiting speech is not the way to handle ignorance This action is not the act of speaking but an act we perform by speaking a speech act Limiting the speech of University students across America merely avoids the face-to-face insults that are unprotected by the First Amendments
