Aboriginal laws were never written They were passed on by word of mouth from one generation to the next Their elders of the tribe decided upon aboriginal laws The other members of the tribe generally accepted them When a law was broken it was usually for the person who had broken the law to meet in public with the person who had been affected by the action The rest of the whole tribe would witness this confrontation After the penalty was decided it was usually the tribe as a group that would carry out the punishment Punishments ranged from the withdrawing of a right to banishment from the tribe or even death When Captain Cook arrived at Botany Bay he took possession of The Great Southern Continent for England He imposed English law on the whole of the continent English law was to be obeyed by everyone who lived in that continent which includes convicts free settlers and soldiers but also the Aborigines who had been living in Australia for thousands of years As far as the new settlers were concerned the Aboriginal people had to accept English law Conflicts broke out between the new settlers and the Aboriginal people The Aboriginal people of Australia have not enjoyed many wins over the past 200 plus years The imposed legal system discriminates in favour of the dominant society The rule makers have all the advantage For 204 years before Mabo the indigenous people of Australia suffered under a oppression which denied them the full expression of their culture As a nation we lived the lie that Australia was land water sea and islands that belonged to no one Lawyers gave a comfortable Latin tag to this lie terra nullius Terra nullius silenced us into a inactivity of denial They developed a European culture on terra nullius They raped ruined and polluted terra nullius We diverted rivers damned and wiered changed wetland nurseries into dry dead
