The Article of Confederation was a failure The Articles of Confederation setup a weak national government causing distress in the colonies The founding fathers did not agree on much political rhetoric but they did agree that the Articles of Confederation was not working in the best interest of the new country as originally intended Coining of money taxes and treaties were not constant throughout the states causing rebellions The founding fathers came together in 1787 to try to develop a government for the second time Compromise was the main power source to the constitution creation The Executive Legislative and Judicial Branch operating as a check and balance against each other was born The founding fathers intentions in modern times do not always turn out like expected In recent times the Supreme Court does not limit Presidential power in foreign affairs while congress efforts to restrict executive powers in domestic issues are struck down Without realizing it the founding fathers created three conditions in which the national government operates First the president and congress are working together Secondly Congress does not act and instead gives its power to the president Lastly both congress and the president are in disagreement about their powers and the judicial branch answers the constitutional questions of power When condition three is reached the Supreme Court rulings typically do not infringe on presidential power Although when the president infringes on judicial power the court quickly restricts the president Youngstown Sheet Tube Company v Sawyer 1952 the United Steel Workers Union announced a strike during the Korean War This was problematic because the mill produced machinery for the war effort President Harry S Truman ignoring the Taft-Harley Act of 1947 in which he originally vetoed issued an executive order to keep the mill in operation under the command of the Secretary of Commerce Truman declared that Article II of the constitution overruled the Taft-Harley Act of 1947 The Supreme Court
