Abortion has been a controversial issue since January of 1973 when it was legalized in all 50 states Many debates have reached a stalemate whether it should be legal and the morality of the action How is it justified and why is it legal This paper will be discussing both arguments supporting and opposing abortion However abortion is immoral and violates the childsembryo 5th amendment rights regardless of it being alive or a fetus Personally I believe that abortion shouldnt be legal unless the mothers life is in danger In 1969 a single pregnant woman by the alias Jane Roe returned to her hometown of Dallas Texas to obtain an abortion At the time abortions were illegal unless the woman was raped or in a situation of incest She applied for a legal abortion claiming she was raped but was denied because of the lack of a police documentation of the rape A few months later Roe was referred to attorneys Linda Coffee and Sarah Weddington Attorneys Coffee and Weddington filed a suit in a District court in Texas in regards to Roe in 1970 The defendant was a Dallas county district attorney by the name of Henry Wade who represented the state of Texas After a grueling three year wait the court finally reached their decision Abortion was now legal it was justified by the argument that abortion being illegal violated the womans right to privacy Abortion was later legalized in all of the United States in 1973 due to the Roe vs Wade Supreme Court case The Supreme Court ruled in favor of Roe because the state of Texas violated her constitutional right to privacy Ultimately whether a woman wants to get an abortion or not is a personal decision The government should not have a say in what a woman does with her body Its partner case Doe vs Bolton was argued around the same time period This case was also a
