IntroductionWhen a person goes to jail they have a right to an attorney With this right they can either hire one or if they cannot afford one one would be appointed to them by the state These are called Public Defenders Public Defenders are the same as an attorney they defend their client just like every other lawyer Although the client does not have much of a choice on who defends them because of the limited number of Public Defenders Public Defenders have a very big responsibility defending their clients Coming up with a defense can be a long and painful process for them What can be found out while researching the field of law This includes historical background requirements for the job responsibilities on the job and a general overview of the jobHistory Amendment VI of the Bill of Rights states a person the right 1791 to have the Assistance of Counsel for his defense np Although it says that everyone is entitled to the right of assistance of counsel many people have been denied this right As a result there have been many court cases that have challenged a defendants right to counsel Essentially are all defendants entitled to have an attorney provided by the state Two important court cases that answer this question and practically laid the basis for the job of a public defender are Gideon v Wainwright and Argersinger v Hamlin In each of these court cases neither of the defendants were represented by an attorney They were both sentenced to jail time Both defendants appealed their sentences citing the Sixth Amendments guarantee of a persons right to counsel Gideon v Wainwright upheld the Sixth amendment by unanimous decision stating that the defendant should have been appointed an attorney at the expense of that state to ensure his right to a fair trial
