The law that governs the land in regards to employment whether under the Federal or State jurisdiction has something in common That is to protect the rights of employees against any type of discrimination in the workplace Although these rights are basic knowledge employees are mostly not aware of the protection offered by the Federal State and local governments against the offenders and violators of the Employment Law Nowadays there are many lawsuits filed against company employers towards the rectification of the rights violated according to the Employment Law At least today any complaints from employees regarding discrimination can be heard in the court of law or litigations and can be given a verdict in the end Many people are surprised to learn that there is not a single court system in the United States of America Every state has its own court system to handle cases that involve disputes or crimes that arise within the state The federal government also has a court system to handle cases that involve disputes or issues governed by federal laws or the US Constitution Both the state system and the government have different applications for employment laws as well In order to understand the different eras of the US governmental history one must first understand the history of the relationships between the federal state and local governments The Constitution of the United States establishes a direct link between the state governments and Congress It gives Congress specific powers like declaring war and creating armies Both federal and state laws regulate employment discrimination labor and union issues Generally employment discrimination laws apply to all procedural steps of employment including interviewing hiring advertising giving raises and firing employees The laws state that an employer cannot discriminate on the basis of certain characteristics such as race gender age national origin disability and religion The majority of state laws say that employment is at will meaning the employer
