On June 28 1978 the US Supreme Court declared affirmative action in the case of University of California v Bakke Allan Bakke a Caucasian California man who applied to the medical school Davis at the University of California was denied admission twice even though he exceeded the requirements He filed a law suit against the medical school after finding out his grades and test scores were better than many minority students that had been accepted He felt reverse discrimination was used on him which was conflicting with the Civil Rights Act of 1964 and the fourteenth amendment The Supreme Court ruled in favor of Bakke and ordered that the medical school admit him but the Supreme Court opposed that race could be used as one criterion in the admissions decisions in colleges and universities Beckman 2004 During the next decades the Supreme Court limited affirmative action programs and several states banned affirmative action programs based on race which resulted in more cases of racial discrimination in colleges and universities such as Grutter v Bollinger Gratz v Bollinger and Fisher v University of Texas in Austin because affirmative action was not strictly implemented in colleges and universities to protect students Racial discrimination needs to be eliminated and affirmative action in the enrollment process needs to be kept Racial discrimination is when you treat a person or a group of people differently because of their racial origins Racial discrimination began during slavery against African-Americans and has expanded to different ethnic groups voting rights employment and acceptance of students to colleges and universities According to the Office of Equal Opportunity and Diversity On March 6 1961 John F Kennedy issued Executive Order 10925 which included that government contractors use affirmative action to ensure that employees are being treated fairly and not judged because of their race color national origin or religion On September 24 1965 President Lyndon B Johnson gave a speech at Howard University to
