I chose this particular topic after watching a BBC documentary on how homosexuals are treated in Uganda There are similar documentaries on Kenya too I chose to include South Africa because they are the only country that recognized gay rights and also the first country in the world to adopt such an orientation clause in its constitution and moreover is in Africa as well Homosexual is part of the classification of sexuality preference in our societies today Homosexuals are defined as people who are sexually attracted by other persons of the same sex The words gays or gay people are also common terms used instead of homosexuals whereas lesbians are only used to describe female homosexuals These fundamental definitions of homosexuals already indicate that this minority group is evenly distributed throughout the entire society Homosexuals can be both men and women They exist in all classes social groups races positions and countries regardless of their age or originThe Universal Declaration of Human Rights UDHR Articles 1 and 2 stated everyone is entitled to all the rights and freedoms set forth in this Declaration without the distinction of any kind such as race colour sex language religion political or other opinion The term homosexuality has been in existence from the 19th century this shows that it has been existed since the documentation of human right existed The framers of the constitution did not include the unconstitutionality of discrimination against citizens on the base of sexual preference thus making the discrimination perfectly legalHomosexuals represent a minority population in the society They are less recognized and are not protected by law like those who have same sex partners Furthermore most of the well-known legal instruments do not mention any rights for sexual preferences Though there are instruments relating to gay rights like Yogyakarta principles but these principles are not legally binding on states Homosexuals in Africa specifically Uganda and Kenya are treated inhumanly as they are doused
